Rental Agreement & Waiver
These Terms & Conditions (“Terms”) govern the booking and use of services provided by Hoop Calgary (“Company,” “we,” “us,” or “our”). By booking, renting, or using our equipment or services, you (“Customer,” “you”) agree to be bound by these Terms.
1. Services
Hoop Calgary provides mobile basketball entertainment equipment and related services (“Equipment”) for private and public events. Services include delivery, setup, removal, and limited operational instruction.
a. Trailer includes:
i. 4 arcade basketball machines
ii. Basketballs
iii. Sound system connectable via Bluetooth
iv. LED party-style lights
v. 50ft power cable to your property’s outlet
vi. Generator available at no extra cost if there are no power outlets available
Unless expressly agreed to prior to the event, Hoop Calgary may not provide ongoing supervision during the event. The Customer remains solely responsible for participant conduct and safety.
2. Booking & Payment
A deposit payment of 50% is required at the time of booking unless otherwise agreed in writing.
The remaining balance must be paid within 7 days of your event.
A booking is not confirmed until payment has been successfully processed.
All prices are listed in Canadian dollars (CAD) and may include applicable taxes and fees.
Hoop Calgary reserves the right to refuse or cancel bookings at its discretion.
3. Delivery & Setup Requirements
Customer must provide a safe, level, and unobstructed area suitable for Equipment setup and use.
Trailer space required – 20’X8.5’X10’ (Length X Width X Height in Feet)
Adequate access for delivery vehicles must be available at the scheduled time.
If setup requirements are not met upon arrival, Hoop Calgary may cancel the booking without refund.
Delivery fees, if applicable, are disclosed prior to booking and are based on event location. A fee of $1.50 per km will apply if the event is outside of city limits.
4. Customer Responsibilities
Customer agrees to:
Supervise all participants and ensure Equipment is used safely and only as intended
Follow any verbal or written instructions provided by Hoop Calgary
Prevent unsafe, reckless, or inappropriate use of the Equipment
Return the Equipment in the same condition as delivered, normal wear and tear on basketballs excepted
Customer is responsible for any damage, loss, theft, or vandalism to the Equipment occurring during the rental period due to negligence, misuse, or failure to supervise.
5. Cancellations & Refunds
Cancellation and refund policies may vary by booking and will be communicated at the time of reservation.
Unless otherwise stated:
7+ days before event – full refund of deposit.
2–7 days before event – deposit will be credited towards a future booking (valid for 1 year).
Less than 48 hours – deposit is non-refundable.
Credits may be issued at Hoop Calgary’s discretion
Hoop Calgary may cancel or reschedule services due to unsafe conditions, severe weather, or unforeseen circumstances, in which case a refund or credit will be provided
6. Trailer Damages & Loss
Customer is responsible for any damage, theft, or vandalism to the Hoop Trailer during the rental period caused by negligence or misuse. Repair or replacement costs will be billed to the Customer.
7. Assumption of Risk
a. Customer acknowledges that participation in basketball activities and use of the Equipment involves inherent risks, including the risk of personal injury, property damage, or loss.
b. Customer voluntarily assumes all such risks on behalf of themselves and all participants, whether such risks are known or unknown, foreseeable or unforeseeable.
8. Waiver, Release & Limitation of Liability
To the fullest extent permitted by applicable law, Customer agrees to release, waive, and hold harmless Hoop Calgary, its owners, directors, officers, employees, contractors, and affiliates from any and all claims, demands, causes of action, damages, losses, costs, or expenses arising out of or related to:
Use or misuse of the Equipment
Participation in activities involving the Equipment
Injury, death, property damage, or loss occurring during the rental period
This release includes claims arising from the negligence of Hoop Calgary, except where such release is prohibited by law.
9. Indemnification
Customer agrees to indemnify, defend, and hold harmless Hoop Calgary from and against any claims, liabilities, damages, costs, and expenses (including legal fees) arising from:
Customer’s breach of these Terms
Acts or omissions of Customer or event participants
Claims brought by participants or third parties related to the event or Equipment
This obligation survives the completion of the rental period.
10. Media Release
Customer grants Hoop Calgary permission to capture and use photographs and video recordings taken during the event for promotional and marketing purposes, including online and social media, without compensation.
Customer must notify Hoop Calgary in advance if any participant does not wish to be photographed or recorded.
11. Force Majeure
Hoop Calgary is not liable for delays, interruptions, or cancellations caused by events beyond its reasonable control, including but not limited to severe weather, accidents, power outages, or emergencies.
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the applicable laws of Canada. The parties agree to the exclusive jurisdiction of the courts of Alberta.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14. Agreement
By booking the Hoop Calgary Trailer, the Customer confirms they have read and agree to these Terms & Conditions.
